These Terms of Service (“Terms”) govern your use of brandskyl.com and any purchases you make from Brandskyl (“we,” “us,” “our”). By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.
Brandskyl is a sole trader operated by JEMMINA ANGUS in the United Kingdom. Our registered business address is 60 Lovell Road, UB1 3DL, United Kingdom.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering you confirm you meet that requirement.
2. Products and pricing
We work hard to display every product accurately, including colours, materials, and dimensions. Slight variations may occur due to monitor settings, photography, and natural variations in materials like cotton and wool.
All prices are listed in pounds sterling (GBP £) and include any applicable UK taxes. Prices may change at any time. The price applied to your order is the price displayed at checkout when you submitted it.
If a price is listed in obvious error (for example, a £40 hat shown as £0.40), we reserve the right to cancel the order and issue a full refund before shipping it.
3. Order acceptance and contract formation
Submitting an order is an offer to buy, not a binding contract. A binding sales contract between you and Brandskyl is formed only when we send you a dispatch confirmation email. Until that point, we may decline any order at our discretion, including for suspected fraud, inventory issues, or shipping limitations. If we decline before charging you, you are charged nothing.
4. Payment
Payment is due at checkout. We accept Shop Pay; Visa, Mastercard, American Express, and Discover credit and debit cards; Apple Pay; Google Pay; and Klarna. All transactions are processed in pounds sterling by Shopify Payments and other PCI-DSS compliant providers; we never see or store your full card number on our servers. 5. Shipping and returns
Shipping and returns are governed by our Shipping Policy and Refund & Returns Policy, which are part of these Terms by reference.
6. Your statutory rights
Nothing in these Terms affects your legal rights as a consumer under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, including your right to a 14-day cooling-off period for online purchases and your right to receive goods that are of satisfactory quality, fit for purpose, and as described.
7. Intellectual property
All content on brandskyl.com — logos, product photography, designs, copy, and the Brandskyl name itself — is owned by us or licensed to us. You may not copy, modify, distribute, or use any of it for commercial purposes without written permission.
8. User conduct
When using the site you agree not to:
- Submit false information, place fraudulent orders, or impersonate anyone.
- Use the site to violate any law or third-party right.
- Attempt to bypass security, scrape the site at scale, or interfere with its operation.
- Post or transmit malicious code, spam, or harassing content via the site or our customer service channels.
9. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim related to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential losses.
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) breach of your statutory rights as a consumer; or (d) any other liability that cannot be limited or excluded under English law.
10. Indemnification
You agree to indemnify Brandskyl against any claim or demand arising out of your violation of these Terms or your misuse of the site.
11. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute that cannot be resolved by good-faith discussion will be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of your home country.
12. Alternative dispute resolution
If you have a complaint that we cannot resolve, you can use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr, or contact your local Citizens Advice for guidance on UK-based ADR options.
13. Changes to these Terms
We may update these Terms from time to time. The “Effective date” above tells you when they were last revised. Continuing to use the site after a change means you accept the updated Terms.
14. Severability
If any part of these Terms is found unenforceable, the rest remains in full effect.
